ther reference by the Texaco to the matter of your status. In-

deed, I have, from the very time of my arrival over here, stood

up for your firm in every possible way, in order to obtain the

permission to appoint you in place of Mr. Cheetham, although, es

I had to report to London, the Texaco had recently had unpleasant

experiences in regard to another prominent British firm in Chine.

This fact, of having recommended you strongly, brings me

to a very unpleasant matter, although I mention it with all re-

serve seeing that the information is conveyed to me in the re-

stricted language of cables; and - frankly I cannot as yet be-

lieve that a firm of the standing of Reiss & Co. really intends

what these cables appear to convey.

I hesitate to write it down even -

Mr. Carroll's cable, you have expressed an intention to only work

this business - which we introduced to you if we are eliminated

from it! excepting in so far that you would allow us a return

ex your commission under a supposed contract with the Texas Com-

pany, a contract which you cannot of course enter into without

breaking one of the vital clauses of our present Agreement with

you and for which breach your London house and you would of course

be liable to us for heavy damages.

This would apply also if, in consequence of these and

similar actions against our interests which we entrust to your care, the Texas Company should terminate their contract with us

and appoint others.

A similar action would be if you did what was conveyed

to me in another cable from London. This is that you intend to

give up the agency immediately unless we annull our present

contract with you By this action you would of course jeopar-

dize the whole business which, as I just said, we put confid-

ingly into your care - and naturally you cannot demand, nor ex- pect, of anybody to annull any contract just because that suits

you.
